It’s one of the first questions we hear from Ottawa homeowners planning a new deck: do I actually need a permit for this? The honest answer is “it depends”, but the good news is the City of Ottawa spells out exactly what triggers a permit, and once you know the rules, it’s easy to plan around them.

Here’s what the City actually requires, what happens if you skip it, and how we handle the whole process for you.

Why Permits Matter?

A permit means a City inspector checks your deck while it’s being built, not after. They look at the footings, the framing, and the railings, and compare them to the Ontario Building Code, before any of it gets covered up by decking boards.

That matters for two reasons. First, safety: it confirms your posts are set deep enough to handle Ottawa’s frost, and your railings are actually strong enough to lean on. Second, it protects you later on. If you ever sell your home or need to make an insurance claim, an unpermitted deck can cause problems, there’s no record showing it was built to code.

When Ottawa Requires a Building Permit

According to the City of Ottawa’s official guidance, a permit is required if any of the following apply:

Attached & over 24″ high

Your deck is attached to your house (or right up against it) and the walking surface is more than 600 mm (24 in.) above grade — regardless of how big the deck is.

Main access to your home

Your deck is elevated and serves as the main access into your home — for example, a raised deck leading to your back door.

Freestanding, big & high

Your deck is freestanding (out in the yard, not attached to the house) and it’s both larger than 10 m² (about 108 sq ft) and more than 600 mm (24 in.) above grade.

In plain terms: most raised decks attached to the back of a house need a permit, full stop, no matter the square footage. Freestanding decks get a bit more leeway — a small, low platform deck out in the yard can often skip the permit, but once it grows past roughly 108 sq ft and sits over 24 inches off the ground, it needs one too.

These thresholds are set by the City, not by us, and they’re the kind of detail worth double-checking against your specific lot and plans.

Even when a permit is required, height is only one piece of it. A complete permit application in Ottawa typically also needs:

Buyers’ lawyers and home inspectors routinely check for permits on any deck that should have one. A missing permit can delay closing or reduce your final sale price.
